Terms of Service

These Terms of Service describe the general basis on which Rogeho, registered at Felicjanek 1, Kraków, Poland, provides information through this website and carries out site assessments, proposals, installation works and service contracts for residential and light commercial properties. They are written for general information and do not constitute a specific offer or binding quotation, which is instead set out in a separate written proposal for each individual property.
A. Scope and Acceptance of These Terms
By using this website or requesting a site assessment, quotation or service from Rogeho, a visitor or client acknowledges these general terms. Specific commercial terms for an individual installation or service contract, including price, scope of works and timescale, are set out separately in writing and take precedence over this general document in the event of any inconsistency.
B. Free Site Assessment
A site assessment carried out prior to any quotation is provided free of charge and does not obligate the property owner to proceed with any subsequent proposal. The assessment reflects conditions observed on the date of the visit and the information provided by the occupant at that time. It does not itself constitute a binding offer of works.
C. Quotations and Proposals
Written proposals issued following a site assessment and thermal calculation are valid for the period stated on the document itself. Prices reflect the scope of works described in the proposal, and any change to that scope, including access difficulties discovered once work begins, may result in a revised figure agreed with the client before proceeding.
D. Scheduling of Installation Works
Installation dates are agreed in advance and depend on factors including equipment lead times from manufacturers, weather conditions for outdoor works, and access arrangements at the property. Rogeho aims to keep to agreed schedules and will communicate promptly where a date needs to change.
E. Manufacturer Warranties and Workmanship
Equipment installed by Rogeho is covered by the relevant manufacturer's own warranty terms, which vary by product and are provided to the client at handover. Workmanship carried out directly by Rogeho engineers is covered separately according to the terms stated in the individual proposal for that project.
F. Annual Service Contracts
Annual service contracts describe a schedule of maintenance visits and, where applicable, priority scheduling relative to non-contract callouts. The specific scope of each contract, including the number of visits and checks performed, is set out in the contract document provided at the start of the agreement and may be renewed, amended or ended according to its own terms.
G. Limitation of Liability
Nothing in these terms limits liability where such limitation is not permitted under applicable Polish law, including in respect of damage caused intentionally or through gross negligence. Subject to that, Rogeho's liability in connection with services provided is limited to matters directly related to the specific works or contract concerned.
H. Governing Law and Jurisdiction
These terms and any contract for works or services between Rogeho and a client are governed by the law of Poland. Any dispute arising in connection with them falls within the jurisdiction of the competent Polish courts, without prejudice to any mandatory consumer protection rules that may apply.
